Abstract :
Conflict is normal to society, among the people. Bangladesh has emphasized the role of ADR as a means of facilitating the fundamental right to trial to avoid adversarial hearings in civil suits. Alternative Dispute Resolution (ADR), is a different method for resolving conflicts. The role and operation of courts in society have been influenced by the movements for access to justice and alternative dispute resolution. Both movements have challenged the judiciary for failing to give citizens exact, true, and attainable justice. ADR has also been stressed as a tool for better conflict settlement procedures that provide better results. In Bangladesh, the idea of ADR was first embedded in the family matters, wherein there is arrangement for split the difference or compromise even before profession of judgment. ADR is a viable alternative to traditional courtroom dispute resolution. The role and operation of courts in society has been influenced by the movements for access to justice. The movement has challenged the judiciary for failing to give citizens exact, true, and attainable justice. ADR has also been stressed as a tool for better conflict settlement procedures that provide better results. This paper is an endeavor to give a far reaching thought regarding hindrances in the method of access to justice in our general set of laws and by examining the various methods of ADR under various regulations examine the viability of ADR and to give a few suggestions to the outcome of ADR.
